Grandado Essentials Terms and Conditions
1. Introduction
Grandado provides its services to you subject to the notices, terms, and conditions set forth in this agreement (the “Agreement”). In addition, when you use any Grandado service (e.g., Customer Reviews), you will be subject to the rules, guidelines, policies, terms, and conditions, including but not limited to the Privacy Notice, applicable to such service, which are incorporated into this Agreement by this reference. Grandado reserves the right to change this site and these terms and conditions at any time.
Accessing, browsing, or otherwise using the Site indicates your agreement to all the terms and conditions in this Agreement. Please read this Agreement carefully before proceeding.
You may be required to enter into a separate agreement, online or offline, with Grandado for a service (“Additional Agreements”). If there is a conflict or inconsistency between the Terms and an Additional Agreement, the Additional Agreement will supersede the Terms only with respect to that particular Service.

2. Use of Grandado
You represent that the information you provide on the Grandado site is accurate and complete. You are responsible for maintaining the confidentiality of your password and for all statements made and acts or omissions that occur under your account. If you believe that someone has used your password or account without your permission, you must immediately notify Grandado. Your account may also be limited or terminated for any reason, in our sole discretion. We may also change, restrict access to, suspend or discontinue Grandado, or any portion of the Grandado site, at any time without notice.
Grandado or its affiliates are not liable for any content on the Grandado site that you find offensive, indecent, or objectionable. Certain products are labeled with age restrictions and may be intended for an adult audience only. By ordering an item with an age restriction, you agree that you meet the age restrictions.
We sell products for use by children; however, these products are intended for sale to adults. If you are not of legal age in your jurisdiction, you may use the Grandado site only with the permission of a parent or guardian.
You may not: Violate or attempt to violate the security of the Grandado Site; Use any device, software or routine to interfere or attempt to interfere with the proper working of the Grandado Site; or Use or attempt to use any engine, software, tool, agent or other device or mechanism (other than the search mechanisms provided by Grandado or other third party web browsers) to navigate or search the Grandado Site.
3. Submitting Content
You represent that the information you provide on the Grandado site is accurate and complete. Your account may also be limited or terminated for any reason, in our sole discretion. 4. Third Party Sites
Grandado allows users to submit and share comments, feedback, submissions, suggestions, questions, ratings, and other content through the Grandado site (“Content”). Content must be written in English.
By submitting Content, you warrant that (1) you are the sole author and owner of the Content; (2) you are at least 18 years of age or, if under 18, you are at least 13 years of age and your submission was made under the supervision of a parent or legal guardian who agrees to be bound by this Agreement; and (3) use of the Content you supply does not violate any term of this Agreement and will not cause injury to any person or entity.
A. License Grant for Submitted Content
If you submit anything to the Grandado site, you automatically grant, or warrant that the owner of such content has expressly granted, Grandado a royalty-free, perpetual, irrevocable, worldwide, unrestricted, non-exclusive license to use, reproduce, create derivative works from, modify, publish, edit, translate, distribute, perform and display the communication or content material in any media or medium, or any form, format, or forum now known or later developed. Grandado may sublicense its rights through multiple tiers of sublicenses. You should not submit any Content to us that you do not wish to license to us. Grandado is and shall have no obligation (1) to maintain any Content in confidence; (2) to pay any compensation for any Content; or (3) to respond to any User Content. You grant Grandado the right to use the name that you submit in connection with any Content.
B. Prohibited Content
You represent and warrant that you will not submit any of the following Content:
a) Content that is false, inaccurate or misleading;
b) Content that contains your full name(s), or any other confidential identifying information of yourself or others;
c) Content that violates any local, state, federal or international law or regulation;
d) Content that infringes upon the rights of others, including patent, copyright, trademark, trade secret, publicity or privacy rights;
e) Content that is unlawful, obscene, derogatory, libelous, threatening, harassing, abusive, slanderous, hateful, or embarrassing to any other person or entity as determined by Grandado in its sole discretion;
f) Advertising, solicitations or spam links to other websites or individuals, without prior written permission from Grandado;
g) Chain letters or pyramid schemes;
h) Content that impersonates any other company, person or entity, including Grandado, its related entities, employees and agents;
i) Content that contains viruses or other harmful computer code;
j) Content that victims, harasses, degrades or intimidates an individual or group of individuals on the basis of religion, gender, sexual orientation, race, ethnicity, age or disability;
k) Content for which you have been compensated or have received any compensation from a third party, unless otherwise authorized in writing by Grandado;
l) Content that violates any policy posted on the Grandado site or interferes with the use of the Grandado site by others.
*Although Grandado cannot review all Content, you understand that Grandado has the right, but not the obligation, to monitor the Content of the Grandado Site to determine compliance with this Agreement and other operating rules that may be established by Grandado from time to time. Grandado has the right, in its sole discretion, to review, move, delete, or refuse to post any Content submitted to the Grandado Site for any reason, including for violation of this Agreement, whether for legal or other reasons. Notwithstanding this right of ours, you are solely responsible for any Content you submit, and you agree to indemnify Grandado and its affiliates for all claims resulting from any Content you submit.
5. Order acceptance and invoicing
All billing information provided must be true and accurate. Providing untruthful or inaccurate information is a breach of this Agreement and may result in cancellation of the order. We may also request additional information from you before accepting an order. We reserve the right to refuse or cancel any order for any reason, including limitations on quantities available for purchase, inaccuracies or errors in product or pricing information, or problems identified by our credit and fraud prevention department. If your order is cancelled after your credit card (or other payment account) has been charged, we will issue a credit to your credit card (or other applicable payment account) in the amount of the charge. We will contact you if all or part of your order is cancelled or if additional information is required to accept your order. Grandado may require a pre-authorization for some orders placed online using a credit or debit card. You will not be charged for this pre-authorisation, but your card issuer may hold this amount for a short period. Your card issuer determines how long the pre-authorisation is held. We do this to ensure that the card details are still valid and that you have sufficient funds to complete the transaction.
By confirming your purchase at the end of the payment process, you agree to accept and pay for the item(s). Also read the Grandado “Payment Methods”
6. Price information
Grandado cannot confirm the price of an item until after your order has been submitted. Pricing errors may occur on the Grandado site or through Grandado marketplace retailers. Grandado reserves the right to cancel orders containing pricing errors, without further obligation to you, even after receipt of an order confirmation or shipping notification from Grandado. Grandado may, at its sole discretion, either contact you for instructions or cancel your order and notify you of such cancellation. Prices for products may differ on the Grandado site or on Grandado – mobile applications (prices and availability remain subject to confirmation at checkout for mobile users).
7. Discount promotions
Promotions are limited to certain periods and may expire or be discontinued with or without notice.
8. Shipping and delivery
Grandado will execute accepted orders within 30 working days at the latest, unless another delivery period has been agreed. Based on our experience, you can expect your shipment much sooner, within 15-20 working days. However, a delivery up to 30 working days is not considered a delay under these conditions. If the delivery is delayed, or if an order cannot be executed or can only be executed in part, the consumer will receive notification of this no later than 30 working days after placing the order. In that case, the consumer has the right to terminate the agreement without costs and is entitled to any compensation. The above conditions may deviate in the event of FORCE MAJEURE (19.1)
Once we receive an order, it is processed as quickly as possible via our automatic system to keep the time for ordering and shipping as short as possible. Unfortunately, despite our best efforts and dedication, we cannot always prevent a single package from being delayed during transport. To ensure that there is enough time for the package to arrive, all our customers have 3 months after the official delivery time to let us know if the order has still not arrived. Once this period has passed, it is no longer possible to investigate the destination of the packages, so it is important that you let us know in a timely manner.
Once this period has passed, we unfortunately cannot issue refunds or reship orders.
9. Returns and warranty
The products can be returned by private customers within 100 calendar days from the delivery date of the products. If the delivery of a product consists of multiple shipments or parts: the day on which the consumer, or a third party designated by him, has received the last partial shipment. Deliveries to companies are excluded from our return policy. Only when Grandado receives the returned product(s) in perfect condition and original packaging, a refund of the full cost* of the purchase can be paid by bank transfer within 14 days.
Grandado will bear the costs of returning the goods. Notwithstanding the above, Grandado is not obliged to reimburse the additional costs if the consumer has expressly chosen a different method of delivery than the cheapest standard delivery offered by the trader.
Incorrect, defective, damaged or incomplete products:
If the customer has received an incorrect, defective, damaged or incomplete product, a return form must be submitted through the customer service portal with photos of the received product.

Warranty: Grandado offers a one-year warranty on all its products.
To process a warranty claim, Grandado requires a notification by email to: legal@mediapress.com.hk , stating the reason for the claim, the order number (this is essential to be able to locate the purchase), the invoice method and photos of the damaged or incorrect products to assess the situation.
10. Information provided on Grandado
Grandado and our customers post a variety of materials on the Grandado site including but not limited to, merchandise information, product descriptions, reviews, comments and in store now information (collectively, “Materials”). The Materials within 7 calendar days “Procedure for Returning Your Order” that appear on the Grandado site are for educational and informational purposes only. Despite our efforts to provide useful and accurate information, errors may occur from time to time. Before acting on any information found on the Grandado site, you should confirm all facts that are important to your decision. Grandado and its information providers make no representations as to the reliability, accuracy, timeliness, usefulness, or completeness of the information on the site. Grandado is not responsible for, and cannot guarantee the performance of, goods and services provided by our advertisers or others to whose sites we link. The product information on the Grandado site may differ from the information on the product materials due to changes in the manufacturer. If you find that a product is not as described, your sole remedy is to return it in unused condition (with the exception of products that are not eligible for return).

11. Export and Import Policy
You acknowledge that certain goods licensed or sold on the Grandado site are subject to the customs and export control laws and regulations of Hong Kong SAR, China and may also be subject to the customs and export control laws and regulations of the country in which the products are manufactured and/or received and agree to comply with all applicable laws. By importing, purchasing or using products from the Grandado site, you agree to comply with the applicable laws, rules and regulations of the above authorities.
All orders are shipped from warehouses in China. Shipping of all packages includes all export costs! When ordering from Grandado, the prices corresponding to the products will be charged and possibly increased with shipping costs. The customer is personally responsible for the import of the delivered goods and liable for all costs of import taxes, import handling costs and VAT when purchasing products from Grandado.
12. Intellectual Property
All copyrights, trademarks, trade dress, other intellectual property and materials, including page headers, images, text, graphics, formats, logos, designs, icons, photographs, written and other materials (collectively, the “IP”) are owned, controlled or licensed by Grandado, one of its affiliates or by third parties who have licensed their materials to Grandado and are protected by Hong Kong SAR, China and international trademark and copyright laws. You may access, view, download and print the IP and all other materials displayed on the Grandado site only for your personal, non-commercial use; provided, however, that you (1) retain all copyright, trademark or other proprietary notices on all IP; (2) do not modify or alter the IP in any way; and (3) do not provide or make available the IP to any third party in a commercial manner. No license, right, title or interest in any materials or software is transferred to you as a result of your use of the Grandado site or your accessing, viewing, downloading or printing of the IP. You may not reproduce (except as noted above), publish, transmit, distribute, display, modify, create derivative works from, sell or participate in any sale of, or exploit in any way, in whole or in part, the IP, the Grandado site or any related software. All software used on the Grandado site is the property of Grandado or its suppliers and protected by Hong Kong SAR, China and international copyright laws. The IP and software on the Grandado site may only be used as a resource for shopping.
Any other use, including reproduction, modification, distribution, transmission, republication, display or performance, of the IP on this site is strictly prohibited. The compilation (i.e. the collection, arrangement and assembly) of all IP on the Grandado site is the exclusive property of this site operator and is also protected by Hong Kong SAR, China and international copyright laws.
Grandado names and logos, and all other graphics, logos, page headers, button icons, scripts, and service names included in or made available through any of the Grandado site are trademarks or trade dress of this site operator in Hong Kong SAR, China and other countries. All other marks are the property of their respective companies.
13. Colors
We have made considerable efforts to accurately display the colors of products that appear on the Grandado site. However, since the actual colors you see will depend on your monitor, we cannot guarantee that your monitor’s display of any color will accurately reflect the actual color or finish of the product.
14. Privacy Policy
At Grandado, we take your privacy seriously. We collect customer information in an effort to improve your shopping experience and inform you about our products and promotions. We do not sell or rent your personal information to third parties, but we may share your information under certain circumstances which will be outlined below. This policy addresses how we handle the personal information we collect and receive from you. Personal information is information about you, such as your name, address, email address, telephone number, and other information that is not otherwise publicly available. If you have any questions about this policy, you may contact us through the Customer Service Portal.
Changes to our Privacy Policy will be updated on our website. You can check for revisions by looking at the revision date at the top of the policy.
WHAT INFORMATION DO WE COLLECT?
We only collect your name, postal address and telephone number when you purchase a product. Please also read our separate “Privacy Statement”
WHAT INFORMATION WE DO NOT COLLECT
We do not collect credit card information or see your credit card numbers at any point in the purchasing process. All credit card transactions are processed through Payment providers.
We also do not collect your friends’ email addresses when you send a wish list to your friends.
HOW YOUR INFORMATION IS USED
When you place an order or make a purchase at Grandado, we use your personal information to process your order. We will send you an email to confirm your order or may contact you by phone, mail, or email if we have other questions about your order or purchase. When you place an order or make a purchase, we will use your email and mailing address to send you information about our products and promotions.
Grandado will never sell your information to third parties. In the unlikely event of a sale of some or all of our business, Grandado will disclose your personal information to a buyer who will abide by the terms of this Privacy Policy. We reserve the right to disclose information about you as required by law, in response to legal process and law enforcement requests, and as necessary to protect the property, interests, and rights of Grandado.
VISITORS FROM THE EUROPEAN UNION?
This section of the Privacy Policy applies only if you use our Site or services covered by this Privacy Policy from a country that is a member state of the European Union, and supplements the information in this Privacy Policy.

When you make a purchase, you may agree to be added to our mailing list. If you do not wish to receive information to improve your shopping experience, please follow the instructions at the bottom of the email you receive to automatically remove yourself from our mailing list. You may also contact us via the customer service portal. Please note that when you make a purchase from us, we will continue to confirm your order by email. In addition, we may need to contact you by phone, email or post with other questions about your order.
PROTECTING CHILDREN’S PRIVACY
Grandado will never knowingly request personally identifiable information from anyone under the age of 13 without prior verifiable parental consent. If we learn that a Grandado customer is under the age of 13, we will delete all personally identifiable information about that person from our files.

This Agreement is effective unless and until terminated by either you or Grandado. You may terminate this Agreement at any time, provided that you cease all further use of the Grandado Site. Grandado may also terminate this Agreement at any time and may do so immediately without notice, and accordingly deny you access to the Grandado Site, if in Grandado’s sole discretion you fail to comply with any term or provision of this Agreement. Upon termination of this Agreement by either you or Grandado, you must immediately destroy all materials downloaded or otherwise obtained from the Grandado Site, as well as all copies of such materials, whether made under this Agreement or otherwise.
The following sections shall survive any termination of this Agreement: “Use of the Grandado Site,” “Submission of Content,” “Order Acceptance and Billing,” “Pricing Information,” “Information Provided on the Grandado Site,” “Export Policy,” “Intellectual Property,” “Indemnification,” “Termination,” “Disclaimer,” “Limitation of Liability,” “Privacy,” and “General.”

19. Limitation of Liability
UNDER NO CIRCUMSTANCES AND UNDER NO LEGAL OR EQUITABLE THEORY, WHETHER IN TORT, CONTRACT, STRICT LIABILITY OR OTHERWISE, SHALL Grandado OR ANY OF THEIR AFFILIATES, EMPLOYEES, DIRECTORS, OFFICERS, AGENCIES, VENDORS OR SUPPLIERS BE LIABLE TO YOU OR TO ANY OTHER PERSON FOR ANY INDIRECT, SPECIAL, INCIDENTAL OR CONSEQUENTIAL LOSS OR DAMAGE OF ANY NATURE ARISING OUT OF OR IN CONNECTION WITH THE USE OF OR INABILITY TO USE THE Grandado SITES, INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOST PROFITS, LOST GOODWILL, LOSS OF DATA, WORK STOPPAGE, ACCURACY OF RESULTS, OR COMPUTER FAILURE OR MALFUNCTION, EVEN IF ANY AUTHORIZED REPRESENTATIVE OF Grandado HAS BEEN ADVISED OF OR SHOULD HAVE KNOWN OF THE POSSIBILITY OF SUCH DAMAGES. SUBJECT TO THE FOLLOWING, IN NO EVENT SHALL Grandado BE LIABLE FOR ANY DAMAGES MORE THAN THE FEES PAID BY YOU IN CONNECTION WITH YOUR USE OF THE Grandado SITES DURING THE SIX MONTH PERIOD PRIOR TO THE DATE ON WHICH THE DAMAGES OCCURRED.
20. General and force majeure
This Agreement represents the entire agreement between the parties and supersedes all prior agreements and representations between them. The headings in this Agreement are for convenience of reference only and in no way define or limit the scope of the section. If any provision of this Agreement is held to be unenforceable for any reason, such provision will be reformed only to the extent necessary to make it enforceable and the remaining provisions of this Agreement will remain in full force and effect. Grandado’s failure to act with respect to a breach of this Agreement by you or others will not constitute a waiver thereof and will not limit Grandado’s rights with respect to such breach or any subsequent breaches. This Agreement will be governed by and construed under the laws of Hong Kong SAR, China without regard to its conflict of law provisions. Any action or proceeding arising out of or relating to this Agreement or your use of the Grandado site must be brought in the high courts of Hong Kong SAR, China and you consent to the exclusive personal jurisdiction of such courts.
THIS PROVISION DOES NOT DEPRIVE CONSUMERS FROM THE EUROPEAN UNION OF THE PROTECTION PROVIDED BY MANDATORY PROVISIONS IN THE LAWS OF THE COUNTRY OF RESIDENCE, WHICH MEANS THAT CONSUMERS FROM THE EUROPEAN UNION ARE ENTITLED TO ALL RELEVANT RIGHTS UNDER THE LAWS OF THE COUNTRY OF RESIDENCE.
19.1 FORCE MAJEURE
Neither party shall be liable for any failure or delay in the performance of its obligations under this Agreement to the extent that such failure or delay is caused by an event of Force Majeure. Force Majeure shall mean any event beyond the reasonable control of a party which by its nature could not have been foreseen or, if foreseeable, would have been unavoidable, including strikes, lock-outs or other industrial disputes (whether involving its own employees or the employees of third parties), failure of energy sources or transport networks, natural disasters, war, terrorism, riots, civil unrest, interference by civil or military authorities, national or international calamities, armed conflict, malicious damage, breakdown of plant or machinery, nuclear, chemical or biological contamination, sonic boom, explosions, collapse of building structures, fires, floods, storms, earthquakes, loss at sea, epidemics or similar events, natural disasters or extreme adverse weather conditions, or the default of suppliers or subcontractors.
21. Procedure for Making a Claim of Copyright Infringement
